2. What information do we collect?
You can visit our site anonymously.
If you choose to register on our website, four categories of data will be processed from and on your behalf:
"Account data"
When you register an account on our site, place an order, subscribe to our newsletter or respond to a survey, basic contact details are collected, such as email address and name of your contact person, company name , address, telephone number, VAT number, preferred language and currency, any purchase order number, any email address of the receivers of the invoice and masked data of the credit card or bank account.
"Configuration data"
We collect your direct contribution to our Cookiebot cloud service (the "Service") after login, such as the domain names of the websites where you implement the Service and the configuration of the content, appearance and behavior towards visitors of the website ("the End Users").
"End user data"
Data generated by End Users who browse your website using the Service. When an End User sends a consent from their websites, the following data is automatically recorded in ITBt:
-The IP number of the end user anonymously (the last three digits are set to '0').
-The date and time of consent.
-User agent of the End User's browser.
-The URL from which the consent was sent.
-An anonymous, random, and encrypted key value.
-The consent status of the End User, which serves as proof of consent.
The consent key and status are also saved in the end user's browser in the first party cookie "CookieConsent" so that the website can automatically read and respect the end user's consent on all subsequent and future page requests. end-user sessions for up to 12 months. The key is used as proof of consent and as an option to verify that the consent status stored in the End User's browser does not change compared to the original consent sent to ITB.
If you enable the "bulk consent" feature of the Service to allow consent from multiple websites through a single End User submission, the Service will also store a separate, unique, random ID with the End User's consent. "System generated data"
The Service automatically creates and stores metadata based on the other types of data, for example:

ITB will inform you about relevant changes related to the Service, such as the implementation of additional functions, by email, if you subscribe to the ITB newsletter from the account settings page in the Service Manager.
3. What do we use this information for?
Any of the pieces of information that we collect from you may be used for one or more of the following purposes:
3.1. To personalize your experience (the information will help ITB to better respond to your individual needs);
3.2 To allow you to control the user experience towards End Users and allow the Service to automatically apply End User consent to other websites of yours;
3.3. To improve our website (ITB continually strives to improve our website offerings based on the information and feedback we receive from our customers);
3.4. To identify you as a contracting party;
3.5. To enable secure login for you in the Service Manager at cookiebot.com;
3.6. Establish a primary channel of communication with you;
3.7. Allow ITB to issue valid VAT invoices and process transactions (your information will not be sold, exchanged, transferred or given to any other company for any reason, without your consent, other than for the express purpose of providing the requested service);
3.8. To allow automated management of subscriptions;
3.9. Produce and display cookie statements to End Users and store and display scan reports;
3.10. Provide you with cumulative information on End Users' choices regarding the types of cookies accepted and generate a graphical representation in the Service Manager; or
3.11. To send periodic emails (the email address you provide for order processing may be used to send you information and updates regarding your order, in addition to receiving occasional company news, if accepted, related updates, products or services , etc.)

4. Legal basis
4.1. EU General Data Protection Regulation (GDPR)
The processing of your data is based on your consent or in case the processing is necessary for the performance of a contract to which you are a party, or to take action when requested before entering into a contract (see GDPR art. 6 ( 1) (a) - (b)).
If the processing is based on your consent, you can withdraw your consent at any time by contacting us using the contact information in clause 1.
To perform a contract regarding the purchase of the ITB Service, you must provide us with the required personal data. If you do not provide us with all the required information, it will not be possible to deliver the Service.
4.2. California Online Privacy Protection Act Compliance
Because we value your privacy, we have taken the necessary precautions to be in compliance with the California Online Privacy Protection Act. Therefore, we will not distribute any personal information to third parties without your consent, except as set out in clause 7.
As part of the California Online Privacy Protection Act, all users of our website can make changes to their information at any time by logging into their account and navigating to the "profile page."
4.3. Compliance with the Children's Internet Privacy Protection Act
ITB complies with the requirements of the Children's Online Privacy Protection Act. We will not knowingly collect any information from anyone under the age of 13. Our site, products and services are directed to individuals who are at least 13 years of age or older.
5. How we protect your information
ITB implements the following technical, physical and organizational measures to maintain the security of your personal data against accidental or illegal destruction or accidental loss, alteration, unauthorized use, unauthorized modification, disclosure or access and against all other illegal forms of processing.
5.1. Availability
The Service uses the extensive features of the cloud environment to ensure high availability, such as full redundancy, load balancing, automatic capacity scaling, continuous data backup and geo-replication along with a traffic manager for automatic geographic fault tolerance in disasters at the data center level. All fault tolerance mechanisms are fully automated.
No personal data is permanently stored outside of ITB's cloud platforms. Physical security is maintained by ITB's subcontractors (see clause 7). Microsoft data centers meet industry standards such as ISO 27001 for physical security and availability; for example, using 24-hour security personnel, two-factor access control through card and biometric readers, barriers, fences, security cameras and other measures.
5.2. Integrity
To ensure integrity, all data transits are encrypted to align with best practices to protect data confidentiality and integrity. For example, all supplied credit card information is transmitted through Secure Socket Layer (SSL) technology and is then encrypted in the database of our payment gateway provider so that those who are authorized to access it can access it. said systems and who must maintain the confidentiality of the information.
For data in transit, the Service uses industry standard transport protocols between Microsoft data centers and devices and within the data centers themselves.
5.3. Confidentiality
All personnel are subject to full confidentiality and any subcontractors and sub-processors must sign a confidentiality agreement if full confidentiality is not part of the main agreement between the parties.
Whenever authorized personnel access personal data, access is only possible through an encrypted connection. When accessing data in a database, the IP number of the person accessing the data must also be previously authorized to gain access.
Any device used to access personal data is protected by ITB's Azure Active Directory (AAD), Microsoft's cloud-based access and identity management service, and has ITB's corporate antivirus solution installed. If personal data is temporarily stored on a device, the device's storage drive must also be strongly encrypted.
Local devices that temporarily store personal data are, at all times, except when not used or actively moved under 24/7 supervision, locked in a safe. Personal data is never stored on mobile devices such as USB sticks and DVDs.
5.4. Transparency
Cybot will keep you informed at all times about changes in processes to protect privacy and data security, including practices and policies. At any time you can request information on where and how the data is stored, protected and used. itb will also provide summaries of any independent audits of the Service.
5.5. Isolation
All access to personal data is blocked by default, using a "zero privilege" policy. Access to personal data is restricted to individually authorized personnel. ITB's Security and Privacy Officer issues authorizations and maintains a record of the authorizations granted. Authorized personnel have minimal access if you need it through our AAD.
5.6. Ability to intervene
ITB enables your rights of access, rectification, deletion, blocking and objection mainly by providing integrated functions for data handling in the Service Manager, by offering the option to send instructions through ITB's helpdesk and also by informing and offer the client the possibility to object when ITB plans to implement changes in relevant practices and policies.
General responsibility for data security rests with the ITB Data Protection Officer, who trains and updates all staff on the data security measures described in the ITB security manual and in this Privacy Policy.
5.7. Supervision
ITB uses security reports to monitor access patterns and to proactively identify and mitigate potential threats. Administrative operations, including access to the system, are logged to provide an audit trail if unauthorized or accidental changes are made.
System performance and availability are monitored from internal and external monitoring services.
5.8. Notice of violation of personal data
In the event that your data is compromised, ITB will notify you and the competent supervisory authorities within 72 hours by email with information on the scope of the violation, the data affected, any impact on the service and the ITB's action plan with the measures to protect the data and limit any possible negative effect on the interested parties.
The "personal data breach" refers to a security breach that leads to the destruction, loss, alteration, unauthorized disclosure or access, accidental or illegal, to the personal data transmitted, stored or processed related to the provision of the Service .

7. Disclose information to third parties?
ITB does not sell, exchange or transfer personal data to third parties.
This does not include trusted third parties or subcontractors who help us run our website, conduct our business, or provide service to you. Said trusted third parties may have access to personal data for information needs, and will be contractually bound to maintain the confidentiality of the information.
We may also disclose your information when we believe it is appropriate to comply with the law, enforce our site policies, or to protect our rights (or others), our property, or our safety. 7.1. Trusted subcontractors / third parties
The subcontractors Microsoft Ireland Operations Ltd, Dublin, Ireland, and Fujitsu A / S, Ballerup, Denmark, are being monitored and audited to ISO / IEC 27001 standards. The main subcontractor, Microsoft, has also adopted the international code of practice for privacy in the cloud, ISO / IEC 27018. 7.2. Legally required disclosure
ITB will not disclose customer data to law enforcement authorities, except when instructed to do so or required by law. When governments make a legal claim on ITB customer data, ITB strives to limit disclosure. ITB will only disclose specific data required by the relevant legal requirement.
If you are forced to disclose your data, ITB will notify you immediately and provide you with a copy of the request, unless it is legally prohibited to do so.

9. Where do we store the information?
ITB will not transfer, backup, or retrieve any data stored outside the European Union or Commonwealth
9.1. Location of personal data
All data is stored in databases and file repositories hosted in an Azure data center, at ITB cloud provider, Microsoft Ireland Operations Ltd, in Dublin. All data is automatically replicated in real time to secondary databases with crash recovery and file repositories at Microsoft's data center in Amsterdam, The Netherlands.
The databases are continuously backed up to allow restoration at any time, within a retention period of 35 days. Backups are stored in the file storage location, located in the same geographic location as the database.
A copy of the account data is also stored in ITB´s cloud accounting system, Economic International A / S, Copenhagen, Denmark, hosted in a data center operated by Fujitsu A / S.
9.2. Installing software on the client's system in the cloud
No software installation is required to use the Service. The Connected Service Manager can be accessed through a standard web browser, automatically using an encrypted https connection for all communication between your browser and ITB´s server, in order to prevent any information from being intercepted during network transfers .
10. Access assistance, data portability, migration and transfer
At any time you can obtain confirmation from ITB as to whether the personal data concerning you is being processed or not.
At any time you can request a full data copy, which you can transmit to another data controller. Your data will be delivered within 10 business days by ITB as spreadsheet files in Microsoft Excel format. The logical relationships between the data sets will be preserved in the form of unique identifiers. You are required to pay € 1000 plus applicable taxes upon delivery of each data copy order.
11. Request for rectification, restriction or erasure of personal data
11.1. Rectification
At any time you can obtain, without undue delay, a rectification of inaccurate personal data concerning you. See clause 5.6.
11.2. Restriction of processing of personal data
At any time you can request ITB to restrict the processing of personal data when any of the following cases occurs:
a. If you contest the accuracy of the personal data for a period that allows ITB to verify the accuracy of the personal data.
b. If the processing is unlawful and you oppose the erasure of personal data and request the restriction of its use instead.
c. If ITB no longer needs the personal data for processing, but you require it for the establishment, exercise or defense of legal claims.
11.3. Elimination
You can, without undue delay, request the erasure of personal data concerning you, and ITB must erase personal data without undue delay when any of the following cases occurs:
a. If the personal data is no longer necessary in relation to the purposes for which it was collected or otherwise processed.
b. If you withdraw the consent on which the data processing is based, and there is no other legal basis for the processing.
c. If you object to the processing in case it is for direct marketing purposes.
d. If the personal data has been illegally processed.

12. Data retention
12.1. Data retention policy
Account data will be kept by tax regulations for a maximum of five full fiscal years from the cancellation of your Service account.
The configuration data and the data generated by the system will be erased immediately when you cancel the account of the Service.
End-user data will be erased continuously after 12 months from registration, and immediately after canceling the account from the Service.
12.2. Data retention to comply with legal requirements
You cannot require ITB to change any of the predetermined retention periods, except for the erasure reasons set forth in accordance with clause 11.3, but you may suggest changes to comply with industry-specific laws and regulations.
12.3. Restitution or deletion of data
No data, except Account Data, will be retained after termination of the contract. You can request a copy of the data before termination. You should not cancel the Service account until the data copy has been delivered, otherwise ITB will not be able to deliver the data copy.
13. Accountability
ITB uses the wide range of built-in logging functions and audit trails, provided by Microsoft on its Azure cloud platform. ITB also logs all system updates, configuration changes, and access to provide an audit trail if unauthorized or accidental changes are made.
You can request a data protection audit carried out by an independent third party that also accepts ITB. You will pay € 5,000 plus applicable taxes for an audit request, along with € 200 for each hour ITB spends in connection with the audit, as well as any other costs associated with the audit, including the auditor.
14. Cooperation
ITB will cooperate with you to ensure compliance with the applicable data protection provisions, for example, to effectively guarantee the exercise of the rights of the interested parties (right of access, rectification, deletion, blocking, opposition) to manage incidents, including forensic analysis in case of security breach.
